Judge Tracie Hunter filed a civil rights lawsuit against 21 defendants on August 18th, 2015. Some of the defendants include Hamilton County Prosecutor Joe Deters, Retired Judge Norbert Nadel, Hamilton County’s Commissioners, Judge John Williams and others. Judge Hunter accuses Deters and a host of his cronies of acting under color of the law with efforts of retaliation, lying under oath, and unequal treatment based on race.
Judge Hunter filed the suit with plans to represent herself. Before she made history by being the first elected African American Juvenile Court Judge, she practiced law for over 23 years. Although her law license is suspended during this trial process, Judge Hunter stated earlier today on The Lincoln Ware Show, 1230 The Buzz, that “it is my constitutional right as a citizen to be able to represent myself.”
Of course, when Joe Deters caught wind of the lawsuit he just arrogantly responded, “If anyone doesn’t believe that this woman needs professional help, all they need to do is read this lawsuit…” Deters is once again on a reckless tirade to negatively influence the public. So now we are suppose to believe this professional careered woman who was a license attorney for over 23 years, Journalist for over 20 years, and pastor since 2009, is crazy? This coming from a Prosecutor who regurgitates bombastic comments like he has Tourette syndrome.
Deters’ comments is straight out of the ‘How to assassinate your opponent’s character playbook’. Joe along with his local conservative colleagues, follow these baseless talking points with the end goal to make Judge Hunter appear non-credible and unelectable. From Alex Triantafilou calling Hunter incompetent to Joe Deters insinuating that she was responsible for the death of 2 teens, was incredible attempts to character assassinate Judge Hunter.
In the fifty-five paged complaint, Hunter addresses many of the inappropriate, unethical, and under reported acts toward her that has caused harm and damage. A calamity of errors by the County Commissioners’ office to a rogue prosecutor’s office with an unlimited checkbook is just scratching the surface to how this circus came about.
Some of the points Judge Hunter made in her civil suit were the following:
Defendant County immediately hired Defendant Williams independent counsel when he was sued, but refused to hire Judge Hunter independent legal counsel when she was sued 20 times by Defendant Deters, Hamilton County, the public defender, Faller, WCPO and the Cincinnati Enquirer, despite admitting publicly that Defendant Deters had a conflict of interest that legally and ethically precluded him from representing Judge Hunter.
Defendant County caused Defendant Deters to represent Judge Hunter while the Election Lawsuit was ongoing, and remained open until late 2013, allowing Defendant Deters to both sue Judge Hunter and defend Judge Hunter simultaneously, in violation of the law.
Defendant County retained Defendants Bogen and Namei, at the recommendation of Defendant Deters, to represent Judge Hunter and allowed them to continue to represent Judge Hunter even after Commissioners learned and publicly acknowledged that Defendant Deters, Namei and Bogen failed to file answers in 12 lawsuits filed against Judge Hunter.
Defendant Deters, with intent to maliciously and vindictively convict Judge Hunter of charges he knew to be false, withheld critical exculpatory evidence in Judge Hunter’s criminal trial that would have proved they knew Judge Hunter did not commit the alleged crimes.
Defendant Deters committed or attempted to commit extortion of Judge Hunter when he stated publicly that he had nothing to do with Judge Hunter being prosecuted, but told multiple individuals that the charges against her would be dismissed if she vacated her judgeship.
Defendant Deters deprived Judge Hunter of a fair trial when he issued a press release one day before Judge Hunter’s trial falsely accusing her of murdering two people with intent to bias the jury and taint her trial to obtain an unlawful conviction, and did; as no less than four jurors admitted that they had seen the negative news coverage and further admitted that it influenced their opinion of Judge Hunter which would interfere with their ability to be impartial.
This is just a fraction of the full complaint expressing multiple occurrences of inappropriate and unethical practices made by the accused defendants. Clearly in the few lines that I retrieved, it revealed the lack luster efforts by the Commissioners’ office to intervene against any of the inappropriate infractions allegedly committed by Deters. It also appears to be alleged that Deters conspired with his staff to deliberately foil lawsuits against Judge Hunter by not responding in her defense within the mandatory timeframe.
As a newly seated judge who fought the past two years to be seated, the bombardment of frivolous lawsuit was just a method to break Judge Hunter down; when that wasn’t enough to do the job then came the frivolous criminal charges. The lawsuit is accusing Deters of prior knowledge of evidence proving Judge Hunter never committed a crime.
The defendants are accused of very methodical plots that are absolutely plausible, especially when one is dealing with a prosecutor who thinks he is above the law. The common denominator between all the defendants is that they are all Republicans with the same political agenda, to destroy the legacy and remove the first African American Democrat Juvenile Court Judge out of her judgeship. The accusation of extortion does not seem that far fetch when they were willing to drop all the charges, if she just gave up her seat.
There are many allegations made in this lawsuit but one of the most damaging is the one where Deters is on record loosely accusing Judge Hunter of being responsible for the death of two juveniles. He made the inflammatory comments a day before her trial in the media, and every headline read the same: “Prosecutors blames Tracie Hunter for the death of two teens”
I think Judge Hunter worked incredibly hard on this suit and she spared no one. I think every miserable individual who made the effort to make her life hell, should have their day in court and stand in judgment. I know Judge Hunter worked too hard for her career and her beliefs to go out without a fight. A wise person once told me that “the worse person to mess with it someone who has nothing to lose.”
